GENERAL TERMS AND CONDITIONS OF UNICAPS GMBH

1. SCOPE

These General Terms and Conditions apply to all contracts between UniCaps GmbH, Im Technologiepark 6, 15236 Frankfurt/Oder (“UniCaps”), and the buyer (“Customer”) for the sale and/or delivery of movable goods (“Goods”).

2. REGISTRATION

Natural persons who have reached the age of 18 as well as legal entities can register as customers with UniCaps. Legal entities must be represented at registration by a person authorized to represent them who has reached the age of 18.

The customer must provide the data requested during registration completely and correctly. If there is a change in the data provided after registration, the customer is obliged to correct the information immediately to UniCaps.

The personal password chosen by the customer when registering on the Internet must be kept secret and may not be made accessible to third parties. The customer is responsible for all actions taken under his password on the Internet pages www.shop.mycoffeecup.de & www.mycoffeecup.de (“Internet presence”).

3. CONCLUSION OF THE CONTRACT

By clicking the button “Buy now” the customer places a binding order for the items in the shopping cart. UniCaps will confirm the receipt of the order to the customer immediately by e-mail (“Confirmation of Receipt”). The confirmation of receipt does not constitute a declaration of acceptance on the part of UniCaps.

A contract is only concluded by the declaration of acceptance on the part of UniCaps. The declaration of acceptance shall be made by means of a separate e-mail either in the form of an order confirmation or a shipping confirmation at the latest after five “working days” (Monday – Friday with the exception of federal public holidays) from receipt of the customer’s order. If the customer does not receive a declaration of acceptance from UniCaps within five working days from receipt of the confirmation of receipt, the customer’s order has not been accepted; a contract is not concluded. Any payments already made by the customer will be refunded to him immediately, at the latest within ten working days from receipt of payment by UniCaps.

4. CANCELLATION POLICY

If the customer is a natural person who concludes a legal transaction for a purpose that can predominantly be attributed neither to his commercial nor to his independent professional activity (consumer), the customer is entitled to the following right of revocation pursuant to § 312g in conjunction with § 355 BGB. § 355 BGB the following right of withdrawal.

INFORMATION ON THE RIGHT OF REVOCATION

You have the right to cancel this contract within fourteen days without giving any reason.

The withdrawal period for a purchase contract is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.

In the case of a contract for several goods which you have ordered as part of a single order and which are delivered separately, the withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the last goods.

In the case of a contract for the delivery of goods in several partial consignments or pieces, the withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the last partial consignment or the last piece.

In the case of a contract for the regular delivery of goods over a fixed period of time, the withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the first goods.

To exercise your right of withdrawal, you must inform us (UniCaps GmbH, Im Technologiepark 6, 15236 Frankfurt/Oder, e-mail: helpdesk@unicaps.eu, Tel.: +49 (0) 335 228802-0, Fax: +49 (0) 335 228802-99) by means of a clear declaration (e.g. a letter sent by post, a fax or an e-mail) of your decision to withdraw from this contract. You can use the model withdrawal form below for this purpose, but it is not mandatory.

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

CONSEQUENCES OF REVOCATION

If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.

You must return the goods to UniCaps GmbH, Im Technologiepark 6, 15236 Frankfurt (Oder) without delay and in any case no later than fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send or hand over the goods before the deadline of fourteen days. We bear the cost of returning the goods.

You only have to pay for any loss of value of the goods if this loss of value is due to the handling of the goods which is not necessary for the inspection of the condition, properties and functioning of the goods.

5. PRICES

The price quotations of UniCaps include the statutory value added tax at the applicable rate.

6. DELIVERY AND SHIPPING COSTS

The customer is informed about the delivery time on the respective product detail page.

Deliveries are made by mail or courier to the shipping address specified by the customer in the order. Deliveries are made exclusively to delivery addresses within the Federal Republic of Germany.

For packaging and shipping of the goods, the customer will be charged € 3.90 for shipping for delivery to Germany. With a minimum order value of 35 € the shipping costs are waived.

Provided that the purchase is not a purchase of consumer goods (§ 474 para. 1 BGB), the risk shall pass to the customer as soon as the delivery has been handed over to the transport person.

7. PAYMENT OPTIONS AND CONDITIONS

If UniCaps does not offer a payment method in an order process in individual cases, the customer can pay by prepayment, credit card, invoice, Paypal, Klarna and amazon pay.

For payments via Paypal, Klarna and amazon pay, the general terms and conditions of the respective payment service provider apply in addition to these GTC.

In case of purchase by credit card, the debit of the customer’s credit card account will be made by UniCaps upon shipment of the order.

8. RESERVATION OF OWNERSHIP

The goods remain the property of UniCaps until full payment by the customer.

9. RETURN

If you have received wrong or damaged goods, you can return unopened goods to us free of charge within 14 days. Simply send a request via our contact form.

Upon receipt of the goods you will immediately receive your refund or replacement.

10. DATA PROTECTION

UniCaps collects data from the customer in the course of processing contracts and takes all necessary measures to protect the personal data provided by the customer and to comply at all times with the applicable national and European data protection regulations. UniCaps provides further details on this under Privacy Policy or sends them to the customer upon request.

11. CHOICE OF LAW AND PLACE OF JURISDICTION

If the customer is a merchant, a legal entity under public law or a special fund under public law, Frankfurt/Oder shall be the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The same shall apply if a customer does not have a general place of jurisdiction in Germany, if a customer has moved his place of residence or habitual abode abroad after conclusion of the contract or if his place of residence or habitual abode is unknown at the time the action is filed.

12. STORAGE OF THE TEXT OF THE CONTRACT

The contract text is not stored at UniCaps. During the conclusion of the contract it can be printed. The customer can find individual transactions in the “Account” section.

13. FURTHER INFORMATION

Here you will find the link to the online platform of the EU Commission for out-of-court online dispute resolution (so-called OS platform). We point out in accordance with § 36 VSBG that we are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
